Terms of Service

1. Agreement

By accessing or using Lyzia, you agree to these Terms of Service. Lyzia is a registered trade name (handelsnaam) at the Dutch Chamber of Commerce (KVK), based in the Netherlands. If you do not agree to these terms, do not use the service.

2. Service description

Lyzia is an AI-powered media archive platform that indexes and analyses your video clips, photographs, audio recordings and finished productions. Lyzia does not store your original media files; we store only the derived index data such as transcriptions, summaries, thumbnails and metadata. Your original files remain on your own storage at all times. The service includes AI-driven visual recognition, transcription, chat-based search, and content generation tools.

3. Accounts

Access to Lyzia requires an account provided by us. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@lyzia.ai if you suspect unauthorised access.

4. Your content

You retain full ownership of all media files and other content you provide to Lyzia. By using the service, you grant us a limited licence to process and analyse your content solely for the purpose of providing the service. We will not share, sell or use your content for any other purpose.

5. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of applicable laws.
  • Upload content that you do not have the rights to use.
  • Attempt to gain unauthorised access to the platform or its infrastructure.
  • Interfere with or disrupt the service or its underlying systems.
  • Reverse-engineer, decompile or attempt to extract the source code of the platform.
  • Share your account credentials with unauthorised third parties.

6. AI-generated output

Lyzia uses artificial intelligence to analyse media, generate transcriptions, answer questions and produce written content. While we strive for accuracy, AI-generated output may contain errors or inaccuracies. You are responsible for reviewing and verifying any output before relying on it in a professional context.

7. Availability

We aim to provide reliable, continuous access to the platform but do not guarantee uninterrupted availability. We may perform maintenance, updates or improvements that temporarily affect access. We will notify you of planned downtime where possible.

8. Fees and payment

Access to Lyzia is provided under a service agreement. Fees, payment terms and billing cycles are specified in your individual agreement with us. We reserve the right to adjust pricing with reasonable notice.

9. Confidentiality

We treat your archive data and metadata as confidential. Access to your data is restricted to authorised personnel required for service delivery and support. Data is strictly isolated between organisations; each client's archives and metadata are stored in separate databases. We will not disclose your content to third parties except as required by law or as described in our Privacy Policy.

10. Intellectual property

The Lyzia platform, including its software, design, branding and documentation, is our intellectual property. These terms do not grant you any rights to our intellectual property beyond the right to use the service as intended.

11. Limitation of liability

To the maximum extent permitted by Dutch law:

  • Lyzia is provided "as is" without warranties of any kind, whether express or implied.
  • We are not liable for indirect, incidental, consequential or special damages arising from your use of the service.
  • Our total liability for any claim related to the service shall not exceed the fees paid by you in the twelve months preceding the claim.

12. Termination

Either party may terminate the service agreement with 30 days written notice. We may suspend or terminate your access immediately if you violate these terms. Upon termination, all associated personal data, including chat history and preferences, is removed immediately as described in our Privacy Policy.

13. Governing law

These terms are governed by the laws of the Netherlands. Any disputes arising from these terms or your use of the service shall be submitted to the competent court in Amsterdam, the Netherlands.

14. Changes

We may update these terms from time to time. Material changes will be communicated through the platform or by email at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
